I read with interest this month an article by two lawyers based in Brussels, who discussed using World Trade Organisation (WTO) rules to enforce and protect energy transit through pipelines.1 The lawyers argue that a valuable legal tool resides within certain WTO rules that provide for the freedom of transit through every member country of the WTO.

This could facilitate transit of oil and gas through pipelines, by enforcing fair transit tariffs, preventing any unsanctioned obstructions or diversions, and easing cross-border construction.
